extract from the Appeal:
"In addition to making out a prima facie case of innocence, Mr. Medina has also demonstrated in this petition that his trial was infected with many constitutional violations including, but not limited to, ineffective assistance of counsel, police and prosecutorial misconduct, and juror misconduct. See supra. Further, these violations affected every phase of his trial beginning
with the police investigation and even continuing to this day. Each of these violations individually undermines the jury’s verdict, and cumulatively, they establish by a preponderance of the evidence that no rational juror would have found Mr. Medina guilty in a constitutionally sound trial."
This Appeal is awaiting judgment of eligibility from the CCA before return to the lower court.
